TERMS OF SERVICE
Terms of service
How quickshop works, what you are responsible for, and what we are. Based on Polish law.
1. Definitions
Service Provider - xKotelek, operator of quickshop and quickpay.
Service - the quickshop website, dashboard and API available at quickshop.kotelek.dev.
User - any person who signs in to the Service and creates or manages a shop.
Player - any person who buys an item from a shop created by a User.
Stripe - Stripe, Inc. and its European entities, which process all payments made through the Service.
2. What the Service does
The Service Provider gives the User tools to create an item shop for a game server, list items for sale, take payments for them and have those items delivered automatically by the server plugin.
The Service is provided as-is. The Service Provider is not liable for interruptions caused by force majeure, unlawful acts of third parties, failures of Discord, Stripe or the User's own infrastructure, provided the Service Provider acted in accordance with the law.
The Service Provider may change or discontinue features, and will give reasonable notice before removing functionality that Users depend on.
3. Payments and fees
Payments are created directly on the User's own connected Stripe account. The Service Provider never holds the User's money.
Stripe's processing fees are charged to the User's Stripe account under the User's agreement with Stripe.
The Service Provider takes a percentage of each sale as an application fee. The current percentage is shown on the pricing section of the website and in the dashboard before a sale is made.
The User is the seller of record for everything sold through their shop. Refunds, chargebacks, tax obligations and consumer-law duties toward Players rest with the User.
4. Using the Service
To use the Service the User needs a Discord account, a Stripe account able to accept payments in their country, and a game server they control.
The User is responsible for keeping their API credentials secret. Credentials can be revoked and regenerated at any time in the dashboard.
It is prohibited to use the Service to break Polish or European law, to violate the Discord Terms of Service or Community Guidelines, to violate Stripe's restricted business rules, or to sell anything the User has no right to sell.
The Service Provider may suspend access for a User who breaks these rules, and will say why when doing so.
5. Accounts and termination
The User may delete their account at any time from the dashboard. Deletion removes their shops, products, orders and credentials from the Service.
quickshop and quickpay are one account. Deleting it from either dashboard deletes both: the User's shops, products and orders on quickshop, and their websites, checkout buttons and sales history on quickpay.
Deleting a quickshop account does not close the User's Stripe account, and does not erase records Stripe is required to keep.
6. Governing law
These terms are governed by Polish law. Nothing here limits rights that consumers have under mandatory provisions of law.
